====================================================== CORAM: HONOURABLE MR. JUSTICE HARISH KUMAR ORAL ORDER 20-11-2025 Heard learned Advocate appearing on behalf of the petitioner and the learned Additional Public Prosecutor for the State.
2. The petitioner apprehends her arrest in connection with Wazirganj P.S. Case No. 569 of 2024, registered for the offences punishable under Sections 126, 115(2), 109, 117, 118(2), 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita.
3. Allegedly on the fateful day while the informant went to his field to construct a boundary, in the meanwhile, all the FIR named accused persons including the petitioner variously armed came there and started assaulting the informant and others.
4. Learned Advocate appearing on behalf of the petitioner submits that besides the fact the petitioner is a
Patna High Court CR. MISC. No.73715 of 2025(2) dt.20-11-2025 2/3 woman, there is no specific allegation ascribed to the petitioner. However, only in order to wreck vengeance and put pressure, her name has been implicated in this case. There is a counter version of the present case being Wazirganj P.S.Case No. 571 of 2024 instituted against the informant and his persons. The petitioner having fair antecedent, has nothing to do with the present offence and claimed to be innocent.
5. On the other hand, learned Advocate for the State vehemently opposed the pre-arrest bail application.

Regard being had to the submissions made on behalf of the parties and considering the fact that the petitioner is a woman having fair antecedent, besides the genesis of the land dispute giving rise to case and counter case, let the petitioner above named be released on bail, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1, Gaya in connection with Wazirganj P.S. Case No. 569 of 2024, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023 with the further condition that
