The petitioner apprehends his arrest in connection with Islampur P.S. Case No.250 of 2017 registered under Sections 379/34 of the Indian Penal Code besides Rules of 4/40 of the Bihar Mining and Consumption, 1972 and Rule 8 of the Bihar Mineral Illegal Transportation Storage Prevention, 2003. The accusation is that the tractor bearing Registration No.BR-21G-4781, loaded with sand was intercepted by the informant being the police official. On being apprehended, the driver of the aforesaid truck disclosed his name as Satish Ravidas,

Patna High Court Cr.Misc. No.47328 of 2017 (2) dt.06-10-2017 2/2 who also disclosed the name of the owner of the same as Om Mahto alias Om Jee (petitioner).

Learned counsel for the petitioner submits that the petitioner is the owner of the seized truck and he had no knowledge about loading of the sand on the aforesaid truck by the driver of the aforesaid truck. The petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, Hilsa, in connection with Islampur P.S. Case No.250 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
