JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-10-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 27 and 29 of the Narcotic Drugs and Psychotropic Substance Act.

A huge quantity smack is said to have been recovered from the house of the petitioner.

Learned counsel appearing for petitioner submits that nothing was recovered either from conscious possession or from the house of the petitioner and as a matter of fact, the petitioner has falsely been implicated. He, further, submits that the petitioner does not have any criminal antecedents and even if the above stated recovery is assumed to be true, then also, the

Regard being had to the above-stated facts and circumstances of the case, particularly, keeping in mind, the huge recovery of smack from the house of the petitioner, I am not inclined to release the petitioner on bail.
