JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2020 This is an application for grant of anticipatory bail in connection with Special Case No. 6762 of 2019, arising out of Kadamkuan P. S. Case No. 479 of 2019, disclosing offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Recovery of 11 liters of liquor from specially designed chamber in Gali of the petitioner.

Submission of the learned counsel for the petitioner is that Gali does not belongs to the petitioner. He has no criminal antecedent.

Heard learned A.P.P. also.

Having heard both sides, in view of the allegation, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, he has to surrender before the learned

Patna High Court CR. MISC. No.68116 of 2019(2) dt.16-01-2020 2/2 court below and make prayer for regular bail, which shall be considered by the learned trial court without being prejudiced by order of this Court, and if, possible to be disposed of on the same day.
