The petitioner seeks bail in connection with S.Tr. No. 79/2017, arising out of Sikandara P.S. Case No. 145 of 2016 dated 16.09.2016 instituted for the offence under Section 394 of the Indian Penal Code.

The petitioner has not been named in the F.I.R. and his name transpired only on the statement of co-accused and information provided by a spy. The petitioner is also said to have disclosed his guilt, but such disclosure, according to the learned counsel for the petitioner, cannot be taken into account for keeping the petitioner in incarceration. Earlier, the petitioner had been made accused in three other cases but he has been granted bail in all such cases. Another co-accused person, having similar allegation, has

The petitioner is in custody since 06.12.2016. For the aforestated facts, this Court is inclined to grant bail to the petitioner.

The petitioner above named is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. 3rd, Jamui in connection with S.
