Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Nautan P.S. Case No. 125/2021 registered for the offences punishable under Sections 413/414 of the Indian Penal Code and Sections 30 and 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner seeks permission to withdraw this application to move the Trial Court for regular bail after surrender.

Patna High Court CR. MISC. No.69957 of 2022(2) dt.04-01-2023 2/2 In view of the fact that the co-accused who had named the petitioner was his own brother and he has been granted regular bail after remaining in custody for a month. The petition is permitted to be withdrawn.

If the petitioner surrenders before the Special Judge, Excise, within two weeks from today, the Special Judge will consider the fact that the petitioner was not arrested on the spot and he has been named in the confessional statement of his brother who has already been granted bail.
