JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-10-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 1610 (C) of 2019, disclosing offence under Section 498A of the Indian Penal Code.
As per F.I.R. there is allegation against the petitioner, who happens to be the father-in-law and mother-in-law of the informant of demand of dowry and also for abusing and assaulting her.
Submission of learned counsel for the petitioners is that no specific allegation has been attributed against the
Patna High Court CR. MISC. No.64830 of 2019(2) dt.17-10-2019 2/2 petitioners and prayer for anticipatory bail of the husband of informant is pending before the lower court for mediation. Heard learned APP also.
Having heard both sides, in view of the facts and circumstances, as stated above, this application is disposed of with a direction to the petitioners to surrender before the learned court below by 05.11.2019 and on surrender, they will be released on provisional bail to the satisfaction of the court below with condition that they have also to participate in the mediation proceedings and considering the report of the Mediator and conduct of both the parties as well as age of the petitioners, the court below shall pass an appropriate order or any other order or orders which may be deemed fit and proper.
