2. The petitioner has preferred this application for grant of regular bail in connection with Kotwali P.S. Case No. 33 of 2024 dated 07.08.2024 registered for the offence/s punishable u/ss 318(4), 319(2), 338, 336(3), 340(2), 61(2) and 3 (5) of the Bhartiya Nyaya Sanhita, Section 10 of the Bihar Conduct of Examination Act and Sections 66(C), 66(D) of the Information and Technology Act.

3. As per the prosecution case, the petitioner and the coaccused persons are alleged to have involved in getting job by way of illegal manner in various competitive examinations and police recovered 12 photo copies of Admit card from the possession of the co-accused, Deepak Kumar Singh.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this

Patna High Court CR. MISC. No.73830 of 2024(2) dt.18-10-2024 2/2 case. The name of the petitioner has sprung up in the confessional statement of the co-accused, Deepak Kumar Singh. Nothing has been recovered from the conscious possession of the petitioner. It is further submitted that the petitioner has no concern with the alleged offence. The co-accused person has already been granted regular bail by this court vide order dated 30.09.2024 passed in Cr. Misc. No. 70458 of 2024. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 08.08.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Darbhanga in connection with Kotwali P.S. Case No. 33 of 2024.

7. The application stands allowed.
