1. Heard learned counsel for the petitioner, learned A.P.P. for the State and the opposite party no. 2.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 409, 420 and 34 of the Indian Penal Code.
3. Learned counsel for the opposite party no. 2, at the outset, submits that he has instruction to make submissions that the opposite party no. 2 shall have no objection in the event if the anticipatory bail application is allowed. It is further submitted that the opposite party no. 2 will also withdraw the present criminal case instituted against the petitioner. It is next submitted that even no dues certificate has also been granted by the opposite party no. 2. It is also submitted that though the
Patna High Court CR. MISC. No.77796 of 2023(3) dt.15-02-2024 2/2 opposite party no. 2 shall withdraw the criminal cases against the petitioner but then he shall have the liberty to recover the interest if any through civil proceedings.
4. Learned counsel for the petitioner submits that he has paid the entire dues to the opposite party no. 2 which would manifest from the fact that no dues certificate has been granted which is annexed as Annexure-3 to the anticipatory bail application.
5. Considering the submissions made by the learned counsel for the opposite party no. 2, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Tilauthu P.S. Case No. 260 of 2022, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
