Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner has preferred this application for grant of regular bail in connection with Runnisaidpur P.S. Case No. 553 of 2022 dated 01.10.2022 registered for the offences punishable u/s 420, 467, 468, 120B of the Indian Penal Code and sections 30 (a), 32, 36 and 41 of the Bihar Prohibition and Excise Act.

As per the prosecution case, on seeing the police party the driver of the truck tried to flee away but he was apprehended

Patna High Court CR. MISC. No.70576 of 2022(2) dt.19-04-2023 2/3 and he disclosed his name as Bikramjeet Singh (the petitioner) and one persons succeeded in fleeing away from the place of occurrence. On search, total 1418.67 litres of illicit liquor, a mobile phone and thread roller machines truck having GPS with Vodafone SIM and papers of truck were recovered from the said truck.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. No such occurrence as alleged has ever taken place. Nothing has been recovered from the conscious possession of the petitioner. He also submitted that there is no eye-witness in this case. The petitioner is accused in one more criminal case which is related to Excise Act as stated in para 3 of the bail petition. The petitioner is in custody since 02.10.2022. Learned A.P.P. for the State has vehemently opposed the prayer for bail of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Sitamarhi in connection with Runnisaidpur P.S. Case
