Petitioner is apprehending his arrest in connection with Sangrampur P.S.Case No.80/19 , registered for offences punishable under Sections 379/461 of the Indian Penal Code. As per FIR, there is commission of theft in the shop of the informant. Petitioner is not named in the FIR and later on his name transpired in the confessional statement. Submission of the learned counsel for the petitioner is that except the confessional statement there is nothing against him and having no recovery. He has no criminal antecedent also.

Having heard both sides and in view of the facts and

Patna High Court CR. MISC. No.64565 of 2019(2) dt.15-10-2019 2/2 circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-14, Motihari in connection with Sangrampur P.S.Case No.80/19, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
