2. The petitioner seeks bail in connection with Sakra P.S. Case No. 200 of 2023 registered for the offence under Sections 302/34 of the Indian Penal Code.

3. As per the prosecution case, the informant is the mother of the deceased and as per her the deceased after being married was staying in his in-laws house for the last twelve years and he was killed by his wife who has illicit relation with one Arbind Mishra.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to village politics. It has further been submitted by the learned counsel for the petitioner that this is a case of no

Patna High Court CR. MISC. No.75378 of 2023(3) dt.10-01-2024 2/2 evidence and no material has come during investigation to show that the petitioner is involved in the murder of the deceased except for suspicion.

5. It is also submitted by the learned counsel for the petitioner that the petitioner has no criminal antecedent and he is in jail since 16.05.2023.

6. Learned APP for the State vehemently opposed the prayer of the petitioner for grant of bail.

7. Considering the aforesaid facts and the period of custody, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-XII, (East), Muzaffarpur in connection with Sakra P.S. Case No. 200 of 2023.
