The petitioner seeks bail in connection with a case registered for the offence punishable u/s 191(2), 191(3), 190, 126(2), 115(2), 109, 303(2), 118(1) of BNS, 2023. 3.

As per F.I.R., 37 named accused persons including the petitioner and other unknown persons assaulted the informant and looted diesel, fertilizer and seeds from him. 4.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has been implicated in this case due to land dispute. From bare perusal of the F.I.R., it is evident that F.I.R. has been lodged against 37 named persons including the petitioner and about 100 unknown persons with general and omnibus allegation of assaulting the informant with

Patna High Court CR. MISC. No.69734 of 2025(2) dt.09-10-2025 2/2 sharp cut weapons. There is no specific allegation against the petitioner. It is further submitted that similarly situated coaccused persons have been granted the privilege of anticipatory bail by a co-ordinate Bench of this Court vide order dated 30.04.2025 passed in Cr. Misc. No.24079 of 2025 and case of this petitioner stands on similar footing. The petitioner is languishing in custody since 25.05.2025.

Learned APP for the State opposed the prayer for bail.

Considering the facts and circumstances of this case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/the Successor Court, in connection with Shamho P.S. Case No.54 of 2024.
