JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-04-2018 The petitioner is apprehending his arrest in connection with Special (POCSO) Case No. 45 of 2017 (arising out of Sikti P.S. Case No. 100 of 2017), registered for offences punishable under Sections 363, 366 (A) of the Indian Penal Code. Allegation against the petitioner is kidnapping minor daughter of the informant.
It has been submitted on behalf of the petitioner that no specific allegation has been levelled and girl has been recovered and her statement under Section 164 Cr.P.C. also does not show any specific allegation and other co-accused person has been acquitted in trial.
Heard learned A.P.P. also.
Having heard both sides, considering the facts and
Patna High Court Cr.Misc. No.15029 of 2018 (3) dt.20-04-2018 2/2 circumstances of the case, nature of allegation, I am not inclined to grant the privilege of anticipatory bail to the petitioner. This application is accordingly dismissed.
The petitioner, if so desire may surrender before the court below and pray for regular bail, which will be considered by the court below on the merit of the case.
