The petitioner apprehends his arrest in a case registered for the offences punishable under Section 420/409 of the Indian Penal Code.

The allegation against the petitioner is that a sum of Rs.12,76,591/- including the interest is recoverable against the petitioner.

It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He has been falsely implicated in this case due to fault committed by the contractor. It is further submitted that the petitioner was paid as an advance for doing certain schemes of the government from the Block, who is working as Panchayat

The work of the said scheme was allotted to the ward member and Mukhiya who are dabang of the society and they have misappropriated the amount due to which work was not completed. It is lastly submitted that the petitioner has deposited Rs.20,37,491/- in the government account on 28.03.2022 and the said information was given to the conducting officer of the departmental proceeding initiated against the petitioner. Petitioner has one criminal antecedent as mentioned in para-3 of this application.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Banka (Barakat) P.S. Case No. 11 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
