2. The petitioner seeks regular bail in a case registered for the offence under Sections 341, 376D, 323, 504, 34 of the Indian Penal Code and Section 4 of the POCSO Act and Section 3(2) of the SC/ST Act.

3. As per the prosecution case, the petitioner is accused of participating in a gang rape.

4. Learned counsel for the petitioner submits that petitioner is quite innocent and has falsely been implicated in this case and the petitioner is in custody since 16.08.2023.

5. Learned A.P.P. has vehemently opposed the prayer for bail and has submitted that sufficient materials have come during investigation to connect the petitioner with the

Patna High Court CR. MISC. No.73093 of 2023(4) dt.27-02-2024 2/2 crime.

6. Considering the allegations levelled against the petitioner, I am not inclined to grant bail to the petitioner. This application for regular bail is dismissed.

7. The court below is directed to expedite the trial of the petitioner.
