The petitioners seeks bail in a case registered under Section 414 of the Indian Penal Code and 27(b) (ii)/28 read with Section 36 of Drugs and Cosmetics Act.

Allegation is that huge quantity of allopathy medicines valued Rs.1,34,050/- is recovered.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 1.8.2019 and have got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioners. There is no allegation in respect of

Patna High Court CR. MISC. No.68158 of 2019(2) dt.19-11-2019 2/2 offence under Section 414 of I.P.C. There is recovery of certain allopathy medicines. In respect of the same, the petitioners had not produced any paper. For the said reasons the present case has been instituted. Except for this, there is no other substantive evidence to suggest the implication of the petitioners in this case.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Araria in connection with Jogbani P.S. case No.218 of 2019.
