The petitioner seeks regular bail in connection with Belaganj P.S. Case No. 124 of 2017, registered for the offence punishable under Sections 395 and 397 of the I.P.C. The allegation as per FIR is that on 23.04.2017 at about 10.30 p.m. when the informant was going to attend marriage ceremony of daughter of one Mukesh Kumar, the accused persons had obstructed the way by cutting a tree and keeping the same on the road, whereafter, the named accused persons along with unknown 18-20 criminals had come at the place of occurrence with lathi and pistol and taken away his cash, driving license and ATM cards.
Learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.45652 of 2017 (2) dt.19-09-2017 2/2 petitioner is not named in the FIR, no incriminating article has been recovered from his possession, has a clean antecedent except one case on which he is on bail from several years. He further submits that the petitioner is languishing in custody since 25.04.2017.
Having regard to the facts and circumstances of the case, I find that this is a fit case in which the petitioner should be released on bail. Accordingly, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M- XI, Gaya, in connection with Belaganj P.S. Case No. 124 of 2017.
