2. Petitioner seeks regular bail in a case registered for the offences punishable under Sections 302, 120 ( B ) and 34 of IPC .

3 . As per F.I.R. all the accused persons variously armed entered the house of one Sadanand Yadav and destroyed the property . Thereafter, it is stated that on 29.02.2020, on hearing the precarious condition of one Mahandan Yadav, when the informant and his mother were going to the hospital, the four named accused persons, including this petitioner assaulted the informant and his mother, who died as a result of assault.

4. Learned counsel for the petitioner submitted that as per F.I.R. petitioner is not the assailant of the deceased . It is

No.70378 of 2025(3) dt.09-12-2025 2/2 further submitted that co-accused Prashant Kumar who along with other co-accused persons are alleged to have assaulted the mother of informant has already been granted bail by Coordinate Bench of this Hon'ble Court vide order dated 23.01.2023 in Cr. Misc. No. 47188 of 2022 . Petitioner is in custody since 19.07.2025 .

5 . Learned A.P.P. for the State as well as learned counsel for the informant vehemently opposed the bail application .

6. Considering backdrop of the case, nature of accusation and custody of the petitioner, let the petitioner named above be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate Madhepura in connection with Singheshwar P.
