JUSTICE RAKESH KUMAR ORAL ORDER 04-04-2018 At the very outset, Sri Manish Kumar no.2, learned counsel, assisted by Sri Vijay Kumar Singh, learned counsel for the petitioners, in presence of Smt. Sahin Begam, learned Addl. Public Prosecutor, submits that during pendency of this petition, petitioner no.4 ( Bachan Singh @ Bachchan Singh) has already been apprehended. Accordingly, the present petition for grant of anticipatory bail in respect of petitioner no.4 has become infructuous.

The petition so far as petitioner no.4 is concerned stands dismissed as the same has become infructuous. Heard Sri Manish Kumar no.2, learned counsel, assisted by Sri Vijay Kumar Singh, learned counsel for the petitioners and Smt. Sahin Begam, learned Addl. Public

The petitioners, apprehending their arrest in Raghunathpur P.S. Case No.162 of 2017 registered for the offence under Sections 341, 323, 307, 379, 504, 506 and 34 of the Indian Penal Code, have prayed for grant of bail, in the event of their arrest or surrender.

Learned counsel for the petitioners submits that so far petitioner no.2 is concerned, in the F.I.R. itself his age has been described as 70 years. He further submits that save and except it was alleged that he was order-giver, there is no other material against him. Accordingly, a prayer has been made to enlarge the petitioners, at least petitioner no.2 on bail, in the event of his arrest or surrender. However, after going through the F.I.R. and considering the fact that there is specific accusation against accused persons, there is no reason to pass favourable order. Accordingly, the prayer for anticipatory bail in respect of petitioners, namely, 1. Raju Singh @ Raju Kumar Singh ( Petitioner no.1), 2. Shiv Sagar Singh(Petitioner no.2), 3. Ram Babu Singh ( Petitioner no.3) and 4. Manan Singh( Petitioner no.5) stand dismissed.
