In this case, the petitioner is seeking anticipatory bail in connection with Taraiya P.S. Case No. 30 of 2017, registered for the offence punishable under Sections 302, 307 and 379/34 of the Indian Penal Code.
As per the F.I.R. in the night the informant has seen three persons flashing torch entering into the Dalan. He understood that they were his grand father and grand mother, who were returning after attending call of nature. After some time, he heard sound of firing and weeping of his grand mother, he rushed towards his house and then he again heard the sound of firing. When he reached near his house, saw accused persons including the petitioner coming out from the Dalan. Seeing them
Patna High Court Cr.Misc. No.22776 of 2018(3) dt.30-04-2018 2/2 when he abused, the accused Bindod Prasad threw a bomb, which exploded at some distance. It is also alleged that the accused persons took away the document kept by his grand father in a box. The grand father and grand mother of the informant died.
Learned counsel for the petitioner submits that three persons who have entered into the Dalan behind back is not the petitioner, but he was in the ground floor, as he has heard the sound of firing he reached there and nothing more than that. Looking to the nature of allegation, this court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected.
