The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 308, 354 and other allied sections of the Indian Penal Code. As per the prosecution case, on the alleged date and time of occurrence all the accused persons assaulted the informant by fist and slaps. It is further alleged that when the daughter of informant came to rescue, the accused persons assaulted her by brick causing head injury.

It is submitted that commission of assault and abuse is general and omnibus in nature. The police after investiation

No.71484 of 2022(2) dt.06-04-2023 2/2 submitted final form on 10.05.2022, but the learned court below differing with the same took cognizance against the petitioners on 08.09.2022. Petitioners claim clean antecedents. Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Basantpur (Lakri Nabiganj OP) P.S. Case No. 338 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) vinita/- U T
