The petitioner apprehends his arrest in connection with Shodra P.S. Case no. 81 of 2018, registered under Sections 279, 337 and 338 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
The accusation is that on receiving the information about accident of the motorcycle, informant along with other Police personnel reached at village-Dumariya then saw one motorcycle was surrounded by several people on which one liter country made liquor also seen kept in polethin. The villagers disclosed that Rishi Kumar (Petitioner), Hariom Kumar and Sushant Kumar were boarded on the said motorcycle and they were driving the motorcycle in drunken
Patna High Court CR. MISC. No.64498 of 2019(2) dt.07-11-2019 2/2 state and dashed another motorcycle on which two girls and one man was sitting and due to dashing the bike, one girl sustained fracture injury at her leg.
Learned counsel for the petitioner submits that petitioner is not owner of the seized motorcycle. Further submission is that petitioner is the resident of P.O village due to that reasons, the villagers disclosed the name of petitioner along with two others due to dirty village politics. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Bettiah, West Champaran in connection with Sahodra P.S. Case No. 81 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
