2. The present writ petition has been filed for the following relief(s) :

"i. For issuance of writ in nature of certiorari to setting aside the notice of encroachment case no. 02/2024-25 pertaining to Mauza Nadwan, Thana NO. 161, Khata No. 720, Khesra No. 1406, Areda 0.54 decimal under section 3 of Bihar Public and Encroachment Act initiated by Circle Officer. Dhanarua Patna who without any information without any notice, red marked at the dwelling old house of the petitioner while encroachment fount only 2.3 links.

3. Without going into the merits or demerits of this case, the present Writ Petition is disposed of at the stage of admission with the consent of both the counsels.

4. Having regard to the fact that the petitioner has challenged the notice issued under the Bihar Public Land Encroachment Act (Annexure P/1) and the petitioner has already filed his objection to the same.

5. The present Writ Petition is disposed of directing the authorities to consider the said objection. Before passing any orders the authority shall put the petitioner on notice and give him an opportunity of hearing. Any orders passed shall be communicated to the petitioner.

6. With the above directions, the Writ Petition stands disposed of.
