Petitioner apprehends arrest in connection with Rajauli P.S. Case No. 450 of 2021 registered for the offence under sections 30(a)(d)/41 of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. Nothing has been recovered from the conscious possession of this petitioner. The alleged recovery has been made from the bushes near the Kabristan of Jobkala which is an open place. Petitioner has no concern with the seized article.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the
