====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 17-10-2019 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners seek bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Prosecution report has been filed without proper investigation of the case for recovery of liquor from possession of three persons including the petitioners. Two of the petitioners have got no criminal antecedent and petitioner no. 2 Pankaj Sahani has got criminal antecedent.

Considering the facts aforesaid, let the petitioner no. 1 Manoj Bhandari and petitioner no. 3 Sudhir Sah, be released on bail, at once, and petitioner no. 2 Pankaj Sahani be released on

Patna High Court CR. MISC. No.61700 of 2019(2) dt.17-10-2019 2/2 bail, after framing of the charges, on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with G.O. Case No. 833 of 2019/P.R. Case No. 29 of 2019, subject to the following conditions:- (a) The petitioners shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioners.

(b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
