Petitioner seeks modification of the order dated 27.02.2018 passed by this Court in Cr. Misc. No. 11604 of 2018 whereby he was granted bail considering the submissions that he has no criminal antecedent though direction was given to the court to verify the criminal antecedent before releasing him. Now, petitioner seeks modification in order by this application that he has one criminal antecedent under Sections 399, 402 and 414 of I.P.C. and of Bihar Excise Act, 2016, so explanation was called for why the bail granted to the petitioner be not cancelled due to suppression of fact.

This matter could not have come before the Court if the order granting bail would not have been subjected to

Patna High Court Cr.Misc. No.16742 of 2018(3) dt.18-04-2018 2/2 verification of the criminal antecedent. The petitioner has got the bail by suppression of the fact relating to his criminal antecedent, so the bail granted to him vide order dated 27.02.2018 passed in Cr. Misc. No. 11604 of 2018 is hereby cancelled.
