Petitioners apprehend their arrest in Aurangabad (T) P.S. Case No.99 of 2018 registered under Sections 147, 148, 149, 337, 323, 435, 436, 427, 307, 332, 295A, 333, 353, 153A, 379 and 120B of the Indian Penal Code.
It is alleged that 130 persons named in the F.I.R. indulged in rioting and setting the shops in the market on fire. They also indulged in pelting stones on the members of other community.
Learned counsel for the petitioners submits that omnibus and general allegations are made against all the
Patna High Court CR. MISC. No.68359 of 2019(2) dt.18-12-2019 2/2 accused persons. Many accused persons have been granted anticipatory bail vide order passed in Cr.Misc.No.50726 of 2018, Cr.Misc.N.58048 of 2018 and other criminal miscellaneous cases. The case of the petitioners stands on same footing.
Having considered the facts that similarly situated accused persons have been granted anticipatory bail by different benches of this court and the case of the petitioners stands on same footing, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Aurangabad (T) P.S. Case No.99 of 2018 subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Harish/- U T
