The accused/petitioners are named in the FIR and apprehending their arrest in connection with Jamhore P.S. Case No.162 of 2021 registered for the offences punishable under Sections 406, 504, 506 read with 34 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act. The allegation against the petitioners is to demand a dowry of Rs.22 lakhs along with other co-accused persons/family members, where amount as received in advance of Rs.10 lakhs was not returned to the informant when negotiation of marriage failed for certain reasons. No.70287 of 2022(2) dt.05-05-2023 2/2 implication of both petitioners are for the reason that petitioner no.1 is the sister and petitioner no.2 is the mother of the Dipak Kumar, the proposed bridegroom. It is submitted that allegation against the petitioners though appearing are general and omnibus and moreover they are ladies of clean antecedent. Learned Additional Public Prosecutor for the State opposes the prayer of bail.

In view of the above-mentioned facts and circumstances, as both petitioners are ladies of clean antecedent, in the event of their arrest or surrender in the court below within a period of four weeks of this order, they are directed to be released on bail furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateIII, Aurangabad in connection with Jamhore P.S. Case No.162 of 2021, subject to the conditions as laid down under Section 438(2) of the CrPC.
