JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-10-2019 This is an application for grant of anticipatory bail in connection with Pirbahore P. S. Case No. 456 of 2019, disclosing offences under Sections 448, 354, 504, 290, 506, 34 of the Indian Penal Code and Section 32(3)/47 of the Bihar Prohibition and Excise Act, 2016.

As per F.I.R. husband of the petitioner and Devar, who were running a girl hostel, where they were taking liquor at the main gate of the hostel and under the influence of liquor, they were using indecent language. It is alleged that accused persons attempted to open the room of one girl. Petitioner is also one of 'Sanchalak' of Hostel and allegation against her that she tried to cover up the matter.

Submission of the learned counsel for the petitioner is that petitioner is lady and there is no allegation of taking any liquor and only allegation against the petitioner is that she was

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, surrender before the court below within a period of three weeks from the date of receipt of certified copy of this order, on surrender, she will be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Special Judge Excise Act, Patna, in connection with Pirbahore P. S. Case No. 456 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that she will not try to tamper with the evidence or threaten the inmates of the girl hostel.
