The petitioners have prayed for grant of bail in connection with Khagaria (Muffasil) P.S. Case No. 76 of 2023 registered under sections 326, 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioners is that they came on motorcycle and petitioner No.1 fired upon the informant due to which he sustained injury.

Learned counsel for the petitioners submits that the petitioner are innocent and have committed no offence. They have falsely been implicated in this case. From perusal of the

Patna High Court CR. MISC. No.72602 of 2023(3) dt.05-01-2024 2/2 injury report, doctor opined that abrasion on the left shoulder of the injured and the nature of injury is simple caused by firearm which has been annexed in this petition as Annexure-2. Moreover, the petitioners are languishing in judicial custody since 25.02.2023.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of this case as well as the custody of the petitioners, the Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail in connection with Khagaria (Mufassil) P.S. Case No. 76 of 2023 on each of them furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. IV, Khagaria.
