The petitioners apprehend their arrest in Aurangabad (T) P.S. Case No.100 of 2018 registered under Sections 147, 148, 149, 337, 323, 435, 436, 427, 307, 332, 333, 353, 153A, 295A, 379 and 120B of the Indian Penal Code.

The informant alleged that he was posted as Magistrate on the eve of Ramnavmi for maintaining law and order. On 25.03.2018, some people of Muslim community started pelting stones on the motorcycle procession of Ramnavmi. On 26.03.2018, the procession was going on peacefully but the community of both sides started pelting stones and they also indulged in arson of shop and vehicle.

Many other accused persons who are named in the F.I.R. such as Navin Kumar Sinha, Nand Kishor Singh, Aditya Singh, Prakash Kumar have been granted anticipatory bail by different Benches of this Court. Other accused persons have already been granted regular bail. The case of the petitioner stands on the same footing.

Taking into consideration the fact that similarly situated co-accused persons have been granted anticipatory bail by different Benches of this Court and the case of the petitioners stands on the same footing, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad (T) P.S. Case No.100 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
