2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 324, 326 and 307 of the Indian Penal Code and Section 27 of the Arms Act.

3. The case of the prosecution is that the petitioner fired at one Abhiraj Kumar and on this information, the police filed an FIR. In this case, the victim was requested by the police to give his statement and to file FIR, but he did not gave his statement.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. During course of the investigation, it has come that the victim was treated at home and he is all well. The injury report was also called from the trial court in which it has come that the victim was not treated at private or

Patna High Court CR. MISC. No.74383 of 2024(5) dt.02-04-2025 2/2 government hospital and in Para-23 of the case diary goes to show that he was treated at home. It is also submitted that prior to this case, the petitioner was remanded in Chandi P.S. Case No. 67 of 2024 and as there was no one to implicate in this case, his name has been implicated. It is further submitted that the petitioner is languishing in judicial custody since 22.06.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Ara Chandi P.S. Case No. 68 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara.
