2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 309(4) and 310(2) of B.N.S.

3. The case of the prosecution is that the informant was going on his bike and was carrying Rs. 72,875 cash. Unknown miscreants intercepted him and took away his bag containing cash.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that the FIR was lodged against unknown miscreants. During investigation, one Niraj Kumar was apprehended and he has named this petitioner in his

Patna High Court CR. MISC. No.70826 of 2025(2) dt.09-10-2025 2/2 confessional statement. It has also been submitted that Niraj Kumar has been granted bail by the learned trial court itself. One other co-accused has been granted bail by learned coordinate Bench of this Court vide order dated 14.08.2025 in Cr. Misc. No. 31018 of 2025. The case of this petitioner stands on similar footing. Moreover, the petitioner is languishing in judicial custody since 28.06.2025.

5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail and submitted that petitioner is having criminal antecedent of one case.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sarai P.S. Case No. 171 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, X, Vaishali at Hajipur.
