2. The present application has been filed for seeking anticipatory bail in connection with Nemdarganj P.S. Case No. 207 of 2023 registered for the offences under Sections 30(a), 30(d), 41 of the Bihar Prohibition and Excise Act.

3. 100 litres of country made liquor has been recovered from an open place.

4. It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent.

5. Learned APP for the State vehemently opposed the prayer for anticipatory bail.

6. Considering the nature of allegation and clean

No.72774 of 2023(2) dt.07-11-2023 2/2 antecedent of the petitioner, let the above named petitioner, in the event of his arrest /surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (Rs. Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Excise Special Judge1st, Nawada in connection with Nemdarganj P.S. Case No. 207 of 2023, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
