JUSTICE SANDEEP KUMAR ORAL ORDER 19-12-2025 Heard the learned counsel for the petitioner, the learned APP for the State and the learned counsel for the informant.

2. The petitioner seeks regular bail in connection with Bidupur P.S. Case No. 397 of 2025 registered for the offence under Section(s) 316(2), 318(4), 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 138 of the N.I. Act.

3. As per the prosecution case, the petitioner is accused of taking money in the name of providing job in the Railways. He is alleged to have taken Rs. 10 Lakh from the informant.

4. Learned counsel for the petitioner on instruction

Patna High Court CR. MISC. No.70978 of 2025(3) dt.19-12-2025 2/3 submits that the petitioner is ready to return the entire amount, i.e., Rs. 10 Lakh alleged to have been taken by him from the informant on the ground for providing job, within five months in five equal installments without accepting his guilt.

5. Learned counsel for the informant has submitted that he has no objection if the petitioner returns the entire amount of Rs. 10 Lakh to the informant within five months in five equal installments.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Vaishali at Hajipur/concerned Court below in connection with Bidupur P.S. Case No. 397 of 2025 subject to conditions that:- (i). At the time of furnishing bail bonds, the petitioner shall produce a cheque of Rs. 2 Lakh in the name of the informant in the Court below and after verifying the genuineness of the same, the Court below shall release the same in favour of the informant after accepting the bail bonds of the petitioner.

(ii). Thereafter, on the first Monday of each month, the petitioner shall regularly produce cheque of Rs. 2 Lakh in

(iii). If the petitioner fails to comply with the aforesaid conditions, the Court below shall be at liberty to cancel the bail bonds of the petitioner.
