2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 467, 468, 471, 420 and 120(B) of the Indian Penal Code.
3. Petitioner, being Panchayat Secretary, issued employment certificate on the basis of forged and fabricated document(s) to co-accused Anu Kumari on the basis of which she secured job of Panchayat teacher.
4. It is submitted on behalf of petitioner that after verification of all educational certificates by the concerned department, employment letter had been issued by the committee of 7 members of which petitioner was one of them. Petitioner had no mechanism to verify papers submitted by the
Patna High Court CR. MISC. No.74930 of 2024(2) dt.27-03-2025 2/2 petitioner who retired in 2022. Moreover, co-accused Anu Kumari has already been granted pre-arrest bail by a bench of this Court vide paragraph 7 of the bail petition.
5. Learned counsel for the State does not controvert this fact.
6. Considering the facts and circumstances of the case, this anticipatory bail is allowed. Let the above named petitioner, in the event of arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate VII, Gopalganj in Mohammadpur Police Station Case No.03/2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
