JUSTICE ARUN KUMAR ORAL ORDER 20-02-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Kotwali P.S.Case No. 270 of 2017 registered under Sections 120B, 201, 208, 417, 418, 419, 420, 467 and 468 of the Indian Penal Code.
Allegation in brief is that one Ganesh Kumar, who topped in the merit list of successful candidates in the Intermediate Examination, during investigation it was found that he had already appeared in the Intermediate examination in 1992 and again appeared as a fresh candidate and this petitioner was involved in the racket being the Secretary of the said school from which Ganesh Kumar appeared.
Submission is that petitioner was not Secretary at the relevant point of time; when admission of Ganesh Kumar was
Patna High Court Cr.Misc. No.51424 of 2017 (7) dt.20-02-2018 2/2 taken in the school in the year 2014 whereas petitioner was removed from the Secretary in the year 2012 itself. Having considered the aforesaid facts and circumstances, the petitioner, namely, Ram Kumar Chaudhary, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Patna in connection with Kotwali P.S. Case No. 270 of 2017.
