2. The petitioner seeks bail in connection with Balrampur ( Telta) P.S.Case No. 219 of 2022 registered for the offence punishable under Sections 302,120B/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. The petitioner and others are said to have participated in killing of the deceased.

4. It is submitted by the learned counsel for the petitioner that petitioner is not alleged to have fired on the deceased but he was standing out side the house and firing to support the person for fleeing away from the place of occurrence. The petitioner petitioner is in custody since 01.08.2023. The petitioner has got three criminal antecedents.

5. Considering the fact that even though some accused persons have been granted bail, I am not inclined to grant bail to the petitioner for the present, accordingly, his prayer for bail stands rejected.

6. The Trial court is directed to expedite the trial of the petitioner and conclude the same and if his trial is not concluded, the petitioner may renew his prayer for bail.

7. With the above observation, this application is dismissed.
