2. Petitioner seeks regular bail in case registered for the offences punishable under Sections 126(2), 115(2), 303(2), 74, 117(2) and 3(5) of the B.N.S. and later on section 109, 103
(1) and 103 ( 2 ) of BNS was added.
3 . The prosecution case , in brief, is that informant namely , Sharda devi alleged that on 28.12.2024 , co-accused Vijay Chaudhary came and caught hold of daughter of informant

No.69803 of 2025(3) dt.25-11-2025 2/3 and also dragged husband of informant outside where this petitioner Madan Chaudhary, along with co-accused persons Mahendra Chaudhary and Rahul Kumar indiscriminately assaulted him. It is further alleged that co-accused Vijay Chaudhary assaulted the informant by means of iron rod.
4. Learned counsel for the petitioner submitted that specific accusation of assault on the head of the deceased is against co-accused Vijay Chaudhary . So far as this petitioner is concerned, allegation is general and omnibus against him. No specific allegation of overt act is against him. As per Postmortem report, deceased has sustained injury caused by hard and blunt substance . Petitioner is in custody since 30.07.2025 . Similarly situated co-accused persons have already been granted bail by co-accused persons by Co-ordinate Bench of this Hon'ble Court vide order dated 15.05.2025 in Cr. Misc. No. 25925 of 2025 .
5 . Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts, materials available on record, period of custody and other circumstances of the case , the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten
Patna High Court CR. MISC. No.69803 of 2025(3) dt.25-11-2025 3/3 thousand) with two sureties of the like amount each to the satisfaction of learned ACJM - II, Nawada in connection with Nardiganj P. S. Case No. 454 of 2024 .
