The petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. The prosecution story in brief is that one Vikki Kumar gave a written statement before the officer-in-charge of Chanan Police Station. It has been alleged that on 22.07.2018 in the morning, the informant was going Tetarhat to Mananpur from Scooty to meet the Gautam Kumar the operator of Customer Service Point (CSP) Bank of Baroda. It has also been stated that in the meantime two persons loaded one motorcycle overtake in my Scooty and the one person snatched my bag and fled away, after that informed the Gautam Kumar the operator of Customer
Patna High Court CR. MISC. No.66922 of 2019(2) dt.06-11-2019 2/2 Service Point (CSP) Bank of Baroda and he said that of Rs. 1,99,960/- in his bag.
Learned counsel for the petitioner submits that there is no recovery of any incriminating articles from the conscious possession of the petitioner and his house. There is no T.I.P. has been held by the police officials. The petitioner is in custody since 25.07.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Chief Judicial Magistrate, Lakhisarai, in connection with Chanan P.S. Case No. 102 of 2019.
