The petitioner apprehends his arrest in connection with Sugauli P.S. Case No. 191 of 2017, registered under Sections 420 and 414 of the Indian Penal Code.

The accusation is that, on receiving secret information about collecting the theft motorcycle in the garage of Hari Mahto, the informant along with other police officials reached there and recovered one motorcycle. Thereafter, Hari Mahto, disclosed the name of four persons as his associates, who indulging the theft of motorcycle and also disclosed about selling of theft motorcycle to several persons including the petitioner, on which, police

Patna High Court Cr.Misc. No.47578 of 2017 (2) dt.09-10-2017 recovered one motorcycle from the house of the petitioner. Learned counsel for the petitioner submits that the motorcycle, which is said to be recovered from the house of the petitioner, was purchased by him on payment of price to named accused and they did not disclose that the motorcycle was stolen. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, East Champaran, in connection with Sugauli P.S. Case No. 191 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
