The petitioner seeks bail in connection with Siwan Muffasil (Mahadewa O.P.) P.S. Case No.257 of 2020 registered for the offence under Sections 302, 120B/34 of the Indian Penal Code.

Allegation against the petitioner is to have committed murder of son of the informant along with other coaccused persons. 4.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner has falsely been implicated in the present case and petitioner is not named in the FIR, where, his name surfaced on the basis of hearsay evidence

It is submitted that petitioner was an employee of 'Any Time Security' and he has no concern with the present set of occurrence. It is submitted that specific allegation is not against this petitioner rather allegation against this petitioner is general and omnibus in nature. It is further submitted that similarly situated co-accused person, namely, Prasun Pankaj @ Parsoon Pankaj has already been granted by learned court below through Sessions Trial No.441 of 2022 on 23.01.2023. It is further submitted that petitioner is a man of clean antecedent and he is in custody since 02.05.2023.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

Considering the facts and circumstances and submissions made on behalf of the petitioner, let the petitioner, above named, is directed to be released on bail in connection with Siwan Muffasil (Mahadewa O.P.) P.S. Case No.257 of 2020 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan.
