JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-11-2019 This is an application for grant of anticipatory bail in connection with Laheriasarai P. S. Case No.222 of 2019, disclosing offences under Sections 341, 323, 324, 307, 354, 504, 506, 379, 34 of IPC.
As per F.I.R. while the informant was coming after taking meat, petitioner and other accused persons surrounded him and asked as to why he has deposed in a case and there is specific allegation against the petitioner of assault by Sword, causing injury to her. There is allegation of snatching of cash and ornaments and also of tearing Saree of the informant. Submission of the learned counsel for the petitioner is that as a matter of fact informant was running a Beef shop and petitioner has given a complaint to the I.G. Police, Darbhanga and furthermore, a case was also filed by the petitioner's side against the informant. The injury is simple in nature.
Patna High Court CR. MISC. No.74214 of 2019(3) dt.27-11-2019 2/2 Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that there is allegation of threatening to withdraw the case and also of assault and as such, he does not deserve privilege of anticipatory bail. Having heard both sides, in view of the allegations, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, he has to surrender before the learned court below and make prayer for regular bail.
