JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-11-2019 Petitioner seeks regular bail in connection with Tarabari P. S. Case No. 07 of 2019, registered for the offences punishable under Sections 380 and 457 of IPC. As per F.I.R. from the pocket of informant a theft of Rs.10,000/- and Dastawin Tablet was committed by unknown. The F.I.R. was lodged against unknown person. Later on, petitioner was arrested in connection with other case and thereafter, remanded in this case and he is accused in two other cases.

Submission of the learned counsel for the petitioner is that there is no recovery from his house or from his possession. He is in custody for about 07 months. The charge sheet has already been submitted, as such, there is no chance of tampering with the evidence.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned S.D.J.M., Araria, in connection with Tarabari P. S. Case No. 07 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with condition that he has to co-operate in disposal of the trial.
