Petitioner apprehends his arrest in connection with Samastipur Town P.S.Case No. 187 of 2017 registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.

Allegation against the petitioner is of withdrawing money from the ATM card of the informant.

Submission of learned counsel for the petitioners is that the allegation does not appear to be probable and is absurd. Further submission is that petitioner has returned the ATM card on 18.7.2017 and thereafter some withdrawals were made in between 19.7.2017 and 22.7.2017 and petitioner, who is a student, cannot be made responsible for that and the whole case is false and

Having heard both sides and in the facts and circumstances, this application is disposed of with a direction to the petitioner to surrender in the court below within a period of six weeks along with a Bank Draft of Rs.65,000/- payable to the informant, which has been withdrawn in between 15.7.2017 to 18.7.2017, and in that event the petitioner shall be released on bail to the satisfaction of the court below. Needless to say that above deposit shall be subject to the result of the case. (Vinod Kumar Sinha, J) spal/- U
