JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-03-2020 The petitioner seeks bail in connection with POCSO Case No. 57 of 2019, arising out of Arrah Town P.S. Case No. 391 of 2019 instituted for the offences under Section 376 of the Indian Penal Code and Section 4 and 8 of the Protection of Children From Sexual Offences Act, 2012.

The petitioner is alleged to have ravished a six years old girl. While committing such act, the petitioner was apprehended by the villagers and given to police custody. The victim also has supported the prosecution version in her statement under Section 164 of the Code of Criminal Procedure.

Patna High Court CR. MISC. No.64470 of 2019(3) dt.04-03-2020 2/2 Considering the aforestated facts, this Court is not inclined to grant bail to the petitioner. However, taking into account the fact that petitioner is in custody since 11.08.2019, this Court only directs that the trial of the petitioner ought to commence and expedited.

The petition stands disposed off with the aforesaid observation.
