====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-12-2025 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 121(1), 74, 109, 324(4), 324(5), 352 of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act.
3. As per F.I.R., on 11.02.2025 at about 10 AM, when informant and other police personnel, in course of checking, reached near Saidpur Petrol Pump, 13 named and 7 unknown persons, armed with Lathi, Danda and rod, attacked them and assaulted them. They also damaged police vehicle and thus, caused hindrance in discharge of official duties of police personnel.
4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and has been made accused
Patna High Court CR. MISC. No.71338 of 2025(2) dt.19-12-2025 2/2 in this case only on the basis of confessional statement of coaccused Chiku Kumar. Allegation is general and omnibus. Some of the co-accused persons have already been granted anticipatory bail by coordinate Benches of this Court.
5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering backdrop of the case and nature of accusation, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Sadar (Hajipur) P. S. Case No. 108 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
