The petitioner seeks bail in a case registered under Section 379/411 of the Indian Penal Code.
Allegedly, the petitioner was apprehended with stolen motorcycle of the informant.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 25-07-2019. Charge sheet has already been submitted. The stolen motorcycle is alleged to have been recovered from the petitioner. The petitioner had no knowledge that the motorcycle in question is a stolen property. The petitioner has been made accused in the present case due to mistake of fact.
On behalf of the State, it is submitted that the petitioner is
Patna High Court CR. MISC. No.64586 of 2019(2) dt.17-10-2019 2/2 named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Udakishunganj, Madhepura in connection with Bihariganj P.S.
