JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-02-2020 Heard learned counsel for the petitioners and learned learned Additional Public Prosecutor for the State. The petitioners are in custody in connection with Gaya Kotwali P.S. Case No.366 of 2019 for the offenses under Sections 414, 420/34 of the Indian Penal Code and 37 (2) of the Bihar Prohibition and Excise Act, 2016 and 11/13 of Bihar Bengal Gambling Act.

Learned counsel for the petitioners submits that petitioners have been apprehended on the ground that they have consumed liquor and during breath analyzing test they were found positive. The petitioners are in custody since 11.08.2019. Considering the period of custody, the Court is

Let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/-(Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the Special Judge (Excise Act), Gaya in connection with Gaya Kotwali P.S. Case No.366 of 2019.

In the event the petitioners are found involved in similar other case in future, the Court below shall be at liberty to cancel their bail bonds.
